Özet
This dissertation discusses should law enforcement authorities be able to monitor individuals' communication data from end-to-end encrypted instant messaging applications and how surveillance should be done under the ECHR. First, it will examine the right to communication confidentiality and applicability of instant messaging applications to Article 8 ECHR. Followed by the significance of providing privacy and security within those applications and the place of the end-to-end encrypted system; the hardships of law enforcement authorities on communication data surveillance on end-toend encrypted instant messaging applications and possible solutions will be analysed. Then, surveillance on both content data and metadata will be discussed separately. Finally, how to monitor metadata will be examined.
