Özet
Cinsel Dokunulmazlığa Karşı Suçlar 5237 sayılı Türk Ceza Kanununda; Cinsel Saldırı, Çocukların Cinsel İstismarı, Reşit Olmayanla Cinsel İlişki ve Cinsel Taciz olmak üzere dört ayrı madde ile düzenlenmiştir. Çalışmamızda mağdurun rızası bu dört ayrı suç bakımından ele alınmış, rızanın suçun oluşumuna ve nitelendirilmesine ilişkin etkileri incelenmiştir. Fail ile mağdur arasında ki ilişki, mağdurun yaşı, cinsel eylemin kapsamı ve gerçekleşme biçimi gibi unsurların rızaya etkilerine yer verilmiştir. Çalışma üç ana başlık altında hazırlanmıştır. İlk bölümde rıza kavramı genel olarak ele alınmış, hukuki tanımına yer verilmiştir. İkinci ve ana bölümde cinsel dokunulmazlığa karşı suçlarda mağdurun rızası her bir suç için ayrı ayrı ele alınmıştır. Üçüncü ve son bölümde ise failin mağdurun rızasında hataya düşmesi haline Yargıtay kararları çerçevesinde yer verilmiştir.

Offenses Against Sexual Immunity In the Turkish Penal Code No. 5237; It is regulated under four separate articles: Sexual Assault, Sexual Abuse of Children, Sexual Intercourse with a Minor and Sexual Harassment. In our study, the consent of the victim was discussed in terms of these four different crimes, and the effects of consent on the formation and characterization of the crime were examined. The effects of factors such as the relationship between the perpetrator and the victim, the age of the victim, the scope of the sexual act and the way it was realized, on consent are included. The study has been prepared under three main headings. In the first part, the concept of consent is discussed in general and its legal definition is given. In the second and main part, the consent of the victim in crimes against sexual immunity is discussed separately for each crime. In the third and last part, the case of the perpetrator's fault in the consent of the victim is included within the framework of the Supreme Court decisions.
