Özet
Teknoloji hızla ilerlemektedir. Bu ilerleyişle birlikte birçok ürün teknolojiyle uygun şekilde yeniden üretilmektedir. Geleneksel olarak kullanılan ürünlerin teknolojik şekilde düzenlendiği bir çağda yaşamaktayız. Bu süreçte kullandığımız arabaların da yapay zekâ ile donatılarak üretimine başlanmıştır. Özellikle Avrupa ve ABD ülkelerinde otonom araç üretiminde önemli başarılar elde edilmiştir. Bununla birlikte mevzuat da bu üretimlerle birlikte yeniden güncellenmesi söz konusudur. Bunun da en önemli sebebi, otonom araçların seviyelerine bağlı olarak sürücüsüz araç kullanmaya yönelik tasarımlar olması ve bu nedenle sürücünün sorumluluğunu azaltabilecek güçte olmasıdır. Bu yüksek lisans tez çalışmasında Türk Hukukunda otonom araçların cezai ve hukuki sorumluluğu ele alınmıştır. Literatür araştırması yöntemiyle yapılan bu çalışmada otonom araçların üretimleri dikkate alınarak yabancı kaynakların da desteğiyle, Türk hukukuna ait yerli kaynaklar derlenerek incelenmiş ve otonom araçların hem cezai hem de hukuki sorumluluğu değerlendirilmiştir. Çalışma çerçevesinde görülmüştür ki, otonom araçların üretimi ve kullanımı konusunda Türkiye'deki sistemin henüz gelişmemesinden kaynaklı olarak yeterli mevzuatın olmadığı, iç hukukumuzdaki ceza ve hukuk kaynakları eşliğinde sorumluluk değerlendirmesi yapıldığı tespit edilmiştir.

Technology is advancing rapidly. With this progress, many products are being reproduced in accordance with technology. We live in an age where traditionally used products are technologically regulated. In this process, the cars we use have started to be produced by equipping them with artificial intelligence. Significant successes have been achieved in autonomous vehicle production, especially in European countries and the US. In addition, it is possible for legal regulations to be updated together with these productions. The most important reason for this is that, depending on the level of autonomous vehicles, there are designs for driverless driving and therefore they have the power to reduce the responsibility of the driver. In this master's thesis study, the criminal and legal liability of autonomous vehicles in Turkish Law is discussed. In this study, conducted using the literature research method, domestic sources of Turkish law were compiled and examined with the support of foreign sources, taking into account the production of autonomous vehicles, and both criminal and legal liability of autonomous vehicles were evaluated. Within the framework of the study, it has been determined that there is no adequate legal legislation regarding the production and use of autonomous vehicles due to the fact that the system in Turkey has not yet developed, and liability assessment has been made in the light of criminal and legal resources in our domestic law.
