Özet

ÖZET Bu çalışmada belediyelerde kamu politikalarının oluşturulmasında meclislerin etkinliği sorunu incelenmektedir. Çağımız koşullarında doğrudan demokrasinin büyük ölçüde uygulanamaz hale gelmesi, halk iradesinin temsilciler aracılığıyla kullanılmasını zorunlu kılmaktadır. Bu nedenle günümüzde demokrasi düşüncesinin yaşama geçirilmesinde meclisler en önemli kurumlardan biri haline gelmiştir. Fakat bu güne kadar yapılan çalışmaların sonucundan, belediye meclislerinin genellikle yerel halkı yeterince temsil etmedikleri, görev, yetki ve işleyiş bakımından önemli bir takım eksikliklerinin olduğu anlaşılmaktadır. Dolayısıyla meclis, encümen ve başkan olmak üzere üç ayrı organ ve gerekli hizmet birimlerinden oluşan belediye yönetimi içinde, belediye meclislerinin fonksiyonlarının neler olduğu ve ilgili temel yasal düzenlemelerin yapıldığı tarihten bu yana değişen koşullar karşısında nasıl olması gerektiği sorunu üzerinde durulması gereken önemli bir konudur. Bilindiği gibi belediye meclislerinin oluşumunu, görev ve yetki alanlarını ve çalışma yöntemlerini düzenleyen yasal ve yönetsel kurallar, belediye yönetimi sistemi içinde meclisin etkinliğini belirleyen temel unsurlardan birini oluşturmaktadır. Bu nedenle bu çalışmada, belediyelerde kamu politikalarının oluşturulmasında meclislerin etkinliği konusu, genel olarak belediyelerde kamu politikalarının oluşturulması süreci, meclisin oluşumu ve meclis üyelerinin hukuki statüsü, görev ve yetkileri ve çalışma yöntemi olmak üzere dört açıdan ele alınmaktadır. Etkinlik kavramı ise, sistem içinde meclisin konumuna ve amacına en uygun hizmet etmesi olarak ele alınmaktadır. Önce her bir konuya ilişkin olarak, ilgili yasal ve yönetsel düzenlemeler anlatılmakta ve ardından farklı anlayış ve yorumlar birlikte değerlendirilerek bunların nasıl anlaşılması ve uygulanması gerektiği üzerinde durulmaktadır. Daha sonra bu düzenlemelerdeki eksiklik ve yetersizliklerden kaynaklanan sorunlar incelenmekte ve en sonunda konuya ilişkin olarak şuana kadar ileri sürülen farklı çözüm önerileri dikkate alınarak, belediyelerde kamu politikalarının oluşturulmasında meclisin etkinliğini arttırıcı öneriler geliştirilmektedir. ABSTRACT In this study, the efficiency of the municipal council in constituting of the public politics in municipalities has been studied. In the conditions of this century, the fact that the direct democracy lost its feasibility in large extent has made obligatory that the power of willing and determining of the people should be used through the representatives. Hence, the assemblies have become one of the most important institutions to perform democracy in the life of the people. However, it is understood from the research results till now that the assembly boards do not sufficiently represent the local people and they are deficient on the issues of duty, authorization and working process. Consequently, it must be investigated what the functions of the city council inside the governing body of municipality which consists of three different agency namely, mayor, assembly and committee are and have to be. It is well known that the legal rules and regulations arranging the formation of the city council, the area of duty and authorization and also working methods are one of the fundamental elements which determine the functions and activity of the assembly. Therefore, in this study, the subject of the functions of the assembly board on constituting of the public politics in municipalities has been studied in four different points of view as follows: (i) the process of constituting of the public politics in municipalities, (ii) the constitution of the assembly and the legal status of the members, (iii) the duties and authorizations of the members, and (iv) the working methods or procedures. Here, the concept of functions refers to the service of the assembly in accordance with its position and objectives. First of all, the legal regulations and institutions related to each subject have been studied. Secondly, different understanding and comments on these issues have been evaluated and then it has been given a lot of attention to analyze them and how they should be understand and applied. Finally, the problems resulted from the deficiency and insufficiency on the arrangements have been studied and the proposals increasing the functions of the assembly board on constituting of the public politics in municipalities have been developed taking into consideration the various solution proposals offered previously.
