Özet
Bu çalışma, İslâm hukuk ve siyaset düşüncesinde devlet başkanında aranan şartların tespit ve tahlilini konu edinmektedir. Devlet başkanlığının dinî ahkâmın icrası ve dünyevî işlerin idaresine dönük en büyük sorumluluk makamı olarak taşıdığı önem, bu görevi üstlenecek kimselerde aranacak nitelikler hususunda titizlik gösterilmesini gerekli kılmıştır. Bu nedenle İslâm toplumunu sevk ve idare etme sorumluluğunu üstlenecek olan devlet başkanının hangi niteliklere sahip olması gerektiği meselesi, İslâm hukuk ve siyaset düşüncesi metinlerinde temel bir problem alanını oluşturmuştur. Meşruiyet problemleri ve yöneten, yönetilen ve yönetim ilişkileri açısından büyük önem taşıyan bu meselede, İslâm hukukçuları nasların, yerleşik mezhep kabullerinin, içtihatların ve İslâm tarihi boyunca ortaya çıkan siyasî ve toplumsal tecrübelerin ışığında birtakım şartlar tespit ederek Müslümanları yönetmeye talip olan kişinin bu şartlara sahip olması gerektiğini dile getirmişlerdir. Devlet başkanlığı için gerekli görülen şartların siyasî liderliğin meşruiyeti problemiyle doğrudan ilişkili olması, kuşkusuz konuyu erken dönemlerden modern döneme değin giderek daha esaslı bir tartışma alanı haline getirmiştir. Çalışmanın temel amacı, devlet başkanında aranan şartlar konusu etrafında teşekkül eden literatürün izini sürüp bu literatürün nasıl ve ne yönde bir gelişme gösterdiğini kronolojik bir çerçevede ortaya koymak ve fıkıh mezhepleri arasındaki görüş farklılıklarını da dikkate alarak meselenin İslâm hukuk ve siyaset düşüncesindeki serencamına dair geniş bir çerçeve çizmektir.

This study addresses the identification and analysis of the qualifications required for the caliph/imam in Islamic law and political thought. The importance of the caliphate as the highest authority responsible for the implementation of religious rulings and the management of worldly affairs has necessitated a careful consideration of the qualifications required for those who assume this role. Therefore, the issue of which qualifications the caliph, who bears the responsibility of leading and governing the Islamic community, must possess has become a fundamental problem area in Islamic law and political thought. In this matter, which is of great significance in terms of legitimacy issues and the relationships between ruler, ruled, and governance, Islamic jurists have, in light of religious texts (naṣ), established sectarian doctrines, ijtihads, and the political and social experiences throughout Islamic history, stipulated certain qualifications, asserting that anyone aspiring to lead the Muslim community must possess these attributes. The direct connection between the qualifications deemed necessary for the caliphate and the issue of the legitimacy of political leadership has undoubtedly made this topic an increasingly significant area of debate from the early period to the modern era. The primary aim of this study is to trace the literature formed around the qualifications required for the caliph, to chronologically present how this literature developed and in what direction it evolved, and to draw a broad framework regarding the evolution of this issue in Islamic law and political thought, taking into account the differences of opinion among the various fiqh schools.
