Özet
The term“nationality”does not have a very long history and first usage of the term can be found in some 19th-century documents. However, throughout the time, the meaning of this term in international law underwent some changes and human rights law started to be taken into consideration in the interpretation of the term. Especially, parallel to the developments in human rights law, having a nationality started to be accepted as one of the fundamental human rights and even it was described by some scholars as“right to have rights”. As a result of the global war on terror which especially gained momentum after terrorist attacks in the Western world and because some Western states' citizens involved in these attacks, some governments started to take measures to apply to these individuals and prevent further attacks on them. In that regard, not only in states like the USA, France, Canada, Australia, but also in the UK and the Netherlands some proposals to revoke western citizenships of the individuals who committed terrorist acts have emerged and some regulations have been adopted for that purpose in many countries. In this master's thesis titled as“Revocation of Citizenship of Dual-Citizens as a Counter-Terrorism Measure”, firstly, origins of the term“nationality”, its nature and its meaning today will be explained. Then, relevant regulations in the UK and the Netherlands which aim at, in some circumstances, revocation of citizenships of persons who involved in terrorist actions will be elaborated. In that sense, these regulations will be assessed under international human rights law and the assessment will be particularly in terms of the prohibition on rendering someone stateless, prohibition of discrimination and the right to a fair trial.
