Özet
Tez çalışmamızın konusunu konkordatonun teminatlara etkisi oluşturmaktadır. Tezin birinci bölümünde konkordato mühleti, mühletin sonuçları ve tasdiki üzerinde genel bilgiler verilmiş ve ardından teminat ilişkileri genel hatlarıyla incelenmiştir. Burada öncelikle teminat sözleşmesi üst başlığı açısından genel bilgiler verilmiş ardından ayni ve şahsi teminat türleri açıklanmıştır. Tez kapsamında incelemeye alınan ayni teminat türleri taşınır rehni ve ipotekten ibarettir. Bunun yanında şahsi teminat türlerinden ise kefalet, garanti, aval ve banka teminat mektupları üzerinde durulmuştur. Tezin ikinci bölümü konkordatonun şahsi teminatlara etkisini ihtiva etmektedir. Bu kapsamda yapılan ilk inceleme asıl borcun ödenmesinden borçlu ile birlikte sorumlu olan kişilerin konkordato mühletindeki yeri ve önemi üzerinedir. Ardından kefalet, garanti, aval ve banka teminat mektubu ilişkilerine konkordatonun etkileri incelenmiştir. Şahsi teminat ilişkileri açısından izlenen sistematik, teminat ilişkisinin tarafları açısından verilen mühlet kararının etkilerini ayrı ayrı incelemek üzerine olup, gerektikçe sözleşme ilişkisine dahil olan üçüncü kişiler açısından da incelemeler yapılmıştır. Ardından mühlet kararının verilmesi zamanına göre ayrıma gidilerek açıklamalar detaylandırılmıştır. Bu kapsamda özellikle şahsi teminata başvuru şartları, teminat borcunun kapsamı ve zamanaşımı gibi konular üzerinde konkordatonun etkileri açıklanmıştır. Tezin üçüncü bölümünde konkordatonun rehin ilişkisine etkileri incelenmiştir. Bu kapsamda yapılan ilk inceleme rehnin konkordato mühletindeki yeri açısındandır. Ardından rehin gösterme işleminin geçerliliği yönünden konkordato hükümleri açısından değerlendirmelerde bulunulmuştur. Bunlardan sonra taşınır rehni ve ipotek açısından konkordato mühletinin sonuçları incelenmiştir. Bu bölümde yapılan incelemelerde de şahsi teminatlardaki incelemelerimize benzer bir sistematik kullanılmıştır.

The subject of our thesis is the effects of concordat on collaterals. The first chapter of the thesis provides general information on the concordat period, the consequences of the period, and its confirmation, followed by a general examination of collateral relationships. Here, general information is first provided under the heading of collateral agreements, followed by an explanation of the types of real and personal collateral. The types of real collateral examined in the thesis are movable pledges and mortgages. In addition, personal collateral types such as suretyship, guarantee, aval, and bank guarantee letters are discussed. The second part of the thesis covers the effect of the composition on personal collateral. The first examination in this context concerns the place and importance of persons jointly liable with the debtor for the payment of the principal debt during the composition period. Subsequently, the effects of the composition on suretyship, guarantee, aval, and bank guarantee relationships are examined. The systematic approach followed in terms of personal guarantee relationships is to examine separately the effects of the moratorium decision on the parties to the guarantee relationship, and, where necessary, to examine third parties involved in the contractual relationship. Subsequently, explanations are detailed by distinguishing according to the timing of the moratorium decision. In this context, the effects of the composition on issues such as the conditions for recourse to personal security, the scope of the security debt, and the statute of limitations are explained. The third chapter of the thesis examines the effects of the composition on pledge relationships. The first examination in this context concerns the place of the pledge in the moratorium period. Subsequently, assessments were made regarding the validity of the pledge presentation process in terms of the provisions of the composition. After that, the consequences of the moratorium period were examined in terms of movable pledges and mortgages. A systematic approach similar to our examination of personal guarantees was used in the examinations conducted in this section.
