Özet
Bu araştırmanın amacı, akademisyenlerin telif hakları kapsamında yer alan eğitim istisnasına ilişkin bilgi gereksinimlerini belirlemek, bu gereksinimler doğrultusunda bir e-öğrenme ortamı geliştirmek ve geliştirilen ortamın etkililiğini değerlendirmektir. Çalışma, geliştirme araştırması yaklaşımı çerçevesinde yürütülmüş olup nicel ve nitel araştırma yöntemlerinden yararlanılmıştır. Araştırmanın gereksinim analizi aşamasında, telif haklarında eğitim istisnasına ilişkin alan yazın ve yargı kararları incelenmiş; ayrıca alan uzmanı hukukçularla görüşmeler gerçekleştirilmiştir. Ardından akademisyenlerin mevcut durumlarını ve bilgi gereksinimlerini belirlemek amacıyla anket yoluyla 130 akademisyenden veri toplanmıştır. Belirlenen gereksinimler doğrultusunda, telif haklarında eğitim istisnasına ilişkin etkileşimli ve çoklu ortam destekli bir e-öğrenme ortamı geliştirilmiştir. Geliştirilen ortamın etkililiğini değerlendirmek amacıyla 33 akademisyen bu ortamdan yararlanmış; ön test–son test desenine dayalı akademik başarı testi uygulanmıştır. Bunun yanı sıra kullanıcı deneyimi, sesli düşünme protokolü ve sunucu izleme (log) kayıtları aracılığıyla elde edilen veriler de incelenmiştir. Araştırma bulguları, akademisyenlerin eğitim istisnasına ilişkin başlangıçtaki bilgi düzeylerinin sınırlı olduğunu; e-öğrenme ortamının kullanımı sonrasında ise bilgi düzeylerinde anlamlı farklılık görüldüğünü göstermektedir. Kullanıcı görüşleri, geliştirilen e-öğrenme ortamının öğrenme sürecini destekleyici, kullanışlı ve işlevsel bir yapıya sahip olduğunu ortaya koymuştur. Bu çalışma, telif haklarında eğitim istisnasını hukuk alan yazınında yaygın olarak ele alınan normatif tartışmaların ötesine taşıyarak eğitim teknolojileri perspektifiyle ele alması ve akademisyenlere yönelik yapılandırılmış bir e-öğrenme ortamı sunması bakımından alan yazına özgün bir katkı sağlamaktadır.

The aim of this study is to identify academics' knowledge needs regarding the educational exception within the scope of copyright law, to develop an e-learning environment based on these needs, and to evaluate the effectiveness of the developed environment. The study was conducted within the framework of a developmental research approach, employing both quantitative and qualitative research methods. During the needs analysis phase, the literature and judicial decisions related to the educational exception in copyright law were examined, and expert opinions were obtained from legal experts specializing in the field. Subsequently, data were collected from 130 academics through a survey in order to determine their current status and knowledge needs. In line with the identified needs, an interactive and multimedia-supported e-learning environment on the educational exception in copyright was developed. To evaluate the effectiveness of the developed environment, 33 academics participated in the learning environment, and an academic achievement test based on a pre-test–post-test design was administered. In addition, data obtained through user experience reports, think-aloud protocols, and log records were analyzed. The findings of the study indicate that academics initially had limited knowledge regarding the educational exception. However, after using the e-learning environment, a significant difference was observed in their academic achievement. User feedback also revealed that the developed e-learning environment had a supportive, usable, and functional structure that facilitated the learning process. This study makes an original contribution to the literature by addressing the educational exception in copyright law from an educational technology perspective, moving beyond the normative discussions, and by providing a structured e-learning environment specifically designed for academics.
