Özet
?Büyüksehir Belediyesi? baslığını tasıyan tezimiz üç ana bölüm ve alt bölümlerden olusmaktadır. Birinci bölümde, genel olarak büyüksehir belediyesini ortaya çıkaran nedenler, büyüksehir belediyesinin Türkiye'deki gelisimi ve büyüksehir belediyesi mevzuatının değisim sürecine değinilip, yeni getirilen yasanın eski düzenlemeyle karsılastırılması yapılarak, büyüksehir yönetim modelini olusturan kurumlar ve bunları yapılandıran yasal çerçeve anlatılmıstır. ?kinci bölümde, yine karsılastırmalı bir sekilde büyüksehir belediye teskilatı, personeli, bütçesi ve belediyeler ile olan iliskilerinden bahsedilmistir. Üçüncü bölümde ise karsılastırmalı sekilde büyüksehir belediyelerinin görevleri - yetkileri ve merkezi idareyle olan iliskileri incelenerek, tezimizin esas konusu olan 5216 sayılı Büyüksehir Belediyesi Kanunu'nun getirdikleri, uygulamada karsılasılması muhtemel bazı sorunlar ve çözüm önerileriyle birlikte ele alınarak, elestirilere de değinilerek bir değerlendirme yapılmıs ve tezimize son verilmistir. Tüm dünyada yasanan hızlı nüfus artısı ve buna bağlı olarak ortaya çıkan asırı sehirlesme ülkemizin de tanık olduğu en önemli olgulardandır. Dünya nüfusunun hızla artması ve bunların büyük kısmının yasamını sehirlerde sürdürmeyi tercih etmesi 1950'lerden bu yana sehirlesme sorununa bir de büyüksehirler veya metropoller sorununu eklemistir. Bu nedenlerle, ülkemizde yıllarca çıkması için mücadele edilen ve birçok demokratik açılımlar içeren Belediye Kanunu'nun ve Büyüksehir Belediyesi Kanunu'nun yürürlüğe girmis olması çok iyi bir gelismedir. Yeni yasaların ana felsefesi yerel yönetimlerin güçlendirilmesidir. Simdiye kadar merkezi yönetim tarafından kullanılan yetkilerin kısmen de olsa yerel yönetimlere devredilmis olması ülkenin demokratik geleceği açısından ümit verici olarak değerlendirilebilir. Ancak bu düzenleme yapılırken, belediyelerin ve veya il özel idarelerinin yeni bürokratik kurumlara dönüsmesi tehlikesi, merkezi idarenin hastalıklarının yerel idarelere devri ve onların da islemez kılınması ihtimali dikkate alınmalıdır. ?dareler arası görev taksimatında Türkiye'nin hassasiyetleri, gelenekleri de göz ardı edilmemelidir. Aksi halde kağıt üzerinde yapılan reformların Türk kamu yönetiminin bünyesine uymama ve ciddi sorunlara neden olma ihtimali hiç de küçümsenemez.

Our thesis titled ?Metropolitan Municipality? is composed of three main section and subsections. In the first section it is mentioned generally that the reasons which bring out the metropolitan municipality and the improvement of Metropolitan Municipality in Turkey and the changing process in the legislation of metropolitan municipality and the new law is compared with the old arrangement and it is defined that the associations which form the metropolitan municipality model and the legal framework which configure these associations. In the second section it is mentioned about the metropolitan municipality organization, staff, budget and their relations with municipalities comparatively. In the third section the tasks and authorizations of metropolitan municipalities and their relations with central administration are studied and an evaluation is made by the discussing the bringing of Metropolitan Municipality Law No:5216 which is the main subject of our thesis, the possible problems which can arise in the implementation and resolution advisories together with the criticisms and the thesis is concluded. The rapid population increase and the excessive urbanization in relation with this are the most important phenomenon that Turkey witnesses. Due to the rapid increase in the world population and as most of the population prefer to live in cities, the problem of metropolitan cities or metropoles has arisen in addition to the problem of urbanization since 1950s. Therefore, it is an important development that Municipality Law and Metropolitan Municipality Law has come into force which has been fought to come into force for years and include many democratic expansion. The main philosophy of new laws is to strengthen the local administrations. It can be seen promising in terms of democratic future of the country that the authorizations which was used by central administrations until now has been passed to local administration partially. However, while this arrangement is being done, it must be considered about the danger of turning municipalities and/or special provincial administration into new bureaucratic institutions and passing of the illness of the central administration to the local administration and the possibility of non-functioning of the local administrations. While distributing the tasks between the administrations, Turkey?s sensitivities and traditions should be taken into consideration. Otherwise, it is not underestimated that the reforms done on the paper have the possibility of not conforming to the Turkish public administration and causing severe problems.
