Some strategies have been applied so as to respond to the change trigered by some elements and to make public administration suitable for the contemporary circumstances. We can specify the methods as privitazition, private sector techniques adopted for public administation, e-state, good governance and ?good administration?. Within this scope, we can put forth that there are two fundamental change-strategies pertaining to enhancing the efficiency of the state through limiting the precinct of public administration and to increasing the effectiviness of the state by means of the effective use of the current capacity based on effectiviness, efficiency and productivity. To this end, what gains prominance is the application of private sector techniques such as the New Public Management, strategic management, performance management, performance management, human resources management and total quality management. One of the the most significant strategies used to pace up with the change in the field of administartion is ?e-state?, which entails a system responding to the demands of the public for democracy, participation, good administration and effective service. With the application of e-state, whose sub-elements are mentioned as e-democracy, e-burocracy and egovernance, there is a paradigm change in from ?passive citizen? to ?active one?, paper work to electronic service, one-sided administration to participatory democracy and from inaccessible state to open and transparent state. Nowadays, one of the terms used most ferquently is the concept of ?governance?. According to some authors, as the concept of administration defines the state-centered administration structure, that of governance, as more complex one, defines a process in which the state gives up its primary role and shares its role with several actors. ?Good governance?, widely debated and applied on the level of local goverments, international organizations and supranational organizations like the European Union, entails the enforcement of eight pillars such as participation, supremacy of law, transparency, responsiveness, equality, efficiency, accountibility and strategic vision. While a great change is coming to existance in the public administration, the strategies and methods prescribed by this change have profoundly affected and forces the former concept and practices of the rule of law. Good administration, discussed and legally regulated within the the EU throughout the 1980?s, 1990?s and the early 2000?s, provides the definition of the new administration concept closely associated with the rule of law. Good administartion, as a requirement of human dignity, enables the birth and enforcement of various principles and rights such as the right to be heard, legal aid, Access to documents and information, legitimate expectations, impartiality in the process of decision-making, parallism in procedures, proportionality, reasoning the decisions and indicating legal avenues. In short, good administartion is a concept of open-transparent and participatory administration which possesses all the material and procedural elements of the rule of law and in which the individual is subjected to a treatment suiting human dignity, individual?s legitimate and rightful expectations are met and he or she always finds the state by his or her side, not against him or her. For this reason, the type of administartion which puts in effect good administartion and administartive democracy is, in a real sense, the rule of law. This study lays down the concept and application of good governance and good administartion in the world and the EU in order to enhance the rule of law and participatory democracy. Furthermore, in the course of Turkey?s endevour for the accession to the EU, this study also covers the legal regulations undertaken to establish good administration or administrative democracy, though under the impact of the EU, and assesses the measures that should be taken by Turkey to firmly establish and enhance good administration in Turkey.
