Özet
Kamusal mal ve hizmetlerin kullanımındaki artış bu hizmetlerin daha etkin ve verimli kullanımını gerektirmektedir. Özelleştirme uygulamalarının yayılması, kamusal mal ve hizmetlerin devlet tarafından merkezi yönetimler aracılığıyla etkin verilememesi ve maliyetlerdeki artışa hizmet kalitesinde düşüşte eklendiğinde bu hizmetlerin yerel yönetimlerce verilmesini zorunlu kılmıştır. Bu durum belediyeleri bu hizmet sunumlarında farklı arayışlara yöneltmiştir. Son yıllarda Türkiye'de, özellikle belediyelerin görev ve yetkilerinin genişletilmesi yönünde yapılan yerel yönetim reformları kamu hizmetlerinin birçok yöntemle verilmesini mümkün kılmaktadır. Kamu kurumları ve çalışmanın ana konusu itibariyle belediyeler bu yöntemlerden en çok ihale yöntemini kullanmaktadır. İhale yöntemi daha önce 2886 sayılı Devlet İhale Kanunu ile uygulama alanı bulmaktaydı. Avrupa Birliği uyum yasaları çerçevesinde ve de belediyelerin görev ve yetkilerinin artması ile yeni bir ihale kanununa gereksinim duyulmuş ve 4734 sayılı Kamu İhale Kanunu yürürlüğe girmiştir. Her ne kadar Kamu İhale Kanunu ile belediyelerde ihale yönteminin kullanımındaki sorunlar giderilmeye çalışılmış olsa da uygulamada sorunlar yaşanmakta ve aksaklıklar meydana gelmektedir. Bu çalışma 4734 sayılı Kamu İhale Kanunu'nun özelliklerini, belediyelerdeki ihale süreçlerini ve uygulamada karşılaşılan sorunları ele alıp sorunlar karşısında çözüm önerilerinde bulunmaktadır.

The increase in the use of public properties and services has required efficient utilization of these services. Considering that privatization has expanded, public properties and services cannot be given efficiently by the government through central managements, there is an increase in costs and a decrease in service quality; it is necessary that these services are given by local authorities. This made municipalities search for different attitudes in providing these services. Now that some reforms concerning especially the broadening of duties and power of local authorities have been made in Turkey recently; public services can be given through various methods currently. Public enterprises and municipalities, which are the main subject of the study mostly use the `procurement method? among these. Previously, procurement method was applied with the State Procurement Law numbered 2886. Yet, the need for a new procurement law arose within the framework of the law of harmonization code of the European Union and with the broadening of the duties and power of municipalities; and the Public Procurement Act numbered 4734 was issued. Though this act intended to resolve the problems concerning the utilization of procurement method in municipalities, there are some troubles and defects in practice. This study deals with the properties of Public Procurement Act numbered 4734, procurement procedures in municipalities and the problems encountered in practice, and offers solutions to these problems.
