Özet
Bu araştırma, Türkiye'de adalet yönetimi konusunu kamu yönetimi disiplininin kavramsal araçları ve araştırma yöntemleri ile inceleyen ilk çalışmadır. Devletin yargı gücü ve işlevini odağına alan böyle bir konunun, bir doktora tez çalışmasının tek başına tüketebileceğinden çok daha geniş kapsamı bulunmaktadır. Bu nedenle, araştırma alanının boyutlarını gösteren bir keşif çalışması olmasına öncelik verilmiştir. Siyaset, hukuk ve kamu yönetimi disiplinlerinin parçacıl biçimde incelediği olgu, bütüncül bir yaklaşımla ele alınmıştır.Adalet yönetimi olgusunu tarihsel süreçteki hareketi ile ele almak, geçirdiği dönüşümün dinamiklerini ortaya sermesi açısından önemlidir. Türkiye'de adalet yönetimi, 19. yüzyıl başlarından 20. yüzyılın ortalarına kadar batı Avrupa'dan aktarılarak geliştirilen bürokratik bir modeldir. Kapitalizme eklemlenme süreci ile birlikte Osmanlı'da, adalet yönetimi ile kamu yönetimi iki farklı bürokratik örgütlenme olarak, merkezde ve taşrada aynı kökten ayrışarak ortaya çıkmış ve gittikçe birbirinden bağımsızlaşarak gelişmiştir. İkinci Dünya Savaşı sonrasında Amerika Birleşik Devletleri'ne özgü devlet modeli ?güçler ayrılığı kuramı/projesi? yardımıyla adalet yönetimine de egemen olmaya başlamış ve iki bürokrasinin birbirinden bağımsızlığı noktasında bir adım daha ileri gidilmiştir.İçinde bulunduğumuz reform süreci ise ağ tipi (şebeke-network), esnek, piyasa odaklı olan yönetişimci adalet yönetimi modelini getirmektedir. Yönetişim ?güçler ayrılığı kuramı/projesi? ile çelişse de tıpkı güçler ayrılığı gibi hem bilimsel bir kuram, hem de devlet modelini kuran proje olarak işlev görmektedir. Bu yeni dönemde adalet yönetimi ile kamu yönetimi arasındaki işbölümü piyasa odaklı olarak yeniden biçimlenmekte ve küresel kapitalizmin gereklerine uygun hale getirilmektedir.Tez kapitalist devletin adalet yönetimini tanımlamakta ve kapitalizmin gereklerine göre dönüşümünü göstermektedir. Ardından Türkiye'de bürokratik adalet yönetimi modelinin ortaya çıkışı, gelişimi ve belirgin özellikleri merkez ve taşra ölçeğinde incelenmektedir. Son olarak yönetişimci adalet yönetimi reformları çözümlenmektedir.

This study is the first study that analyzes the subject of the administration of justice inTurkey with conceptual methods and research techniques of the discipline of publicadministration. Such a subject, which takes the judicial power and the function of thestate into focus, has a much broader extent than that can be employed by a Ph D studyalone. Therefore, the priority has been carrying out a survey showing the dimensions ofthe research area. The fact -which is analyzed by politics, law and public administrationas a singular fact- has been handled with a holistic approach.The handling the fact of the administration together with its progress in the historicalprocess is important since it exhibits the dynamics of the transformation it has beenthrough. The administration of justice in Turkey has been a bureaucratic model thatdeveloped by adopting from Europe from the early 19th century till mid 20th century.During the period of integration with capitalism, the administration of justice andpublic administration have emerged as two different bureaucratic organizations, byseparating from a common root in the center and the territory, and have graduallydeveloped independently. After the Second World War, the state model specific to theUnited States of America started to be dominant also in the administration of justicewith the help of the ?theory/project of the separation of powers? and another stepforward has been taken in the independency of the two bureaucracies.However, the reform process we are going through brings about a governance-typemodel of administration of justice which is a network type, flexible and market-focusedmodel. Although governance conflicts with the ?theory/project of the separation ofpowers?, it functions both as a scientific theory and as the project that founds the statemodel, just like the separation of powers does. In this new period, the division of workbetween the administration of justice and the public administration is taking a newshape focused on the market and is being made suitable for the needs of capitalism.The thesis defines the administration of justice of the capitalist state and shows itstransformation according to the needs of capitalism. Consequently, it analyzes theemergence, development and distinct characteristics of the bureaucratic administrationof justice in Turkey in the central and territorial scale. Finally, it analyzes thegovernance-type reforms on the administration of justice.
