SUMMARY“Antidumping in the European Community and Turkish Legal Systems; -A Comparative Analysis both in Legislation and in practive”The topic of the dissertation is the anti-dumping measures as a non-tariff trade barrier which has become one of the favourite trade policy instruments for many countries. There is an intensive use anti-dumping measures in the Community against products originated in the third countries. In this context, products originated in Turkey have been subjected to the Community's anti-dumping investiganitons on many occasions. In this study, anti-dumping mechanisms in Turkey and the EC in the context of Association relationship is analysed both in terms of legislation and practice. The first chapter elaborates a history of the anti-dumping legislation in GATT, EC and also in Turkey. In the second chapter, price dumping is anlysed conceptually. In this framework, price differentiation introduced with an economic meaning and the theoretical basis of the price dumping established. Following the theoretical basis of the price dumping, motives and types of dumping are examined. Finally, criticism against anti-dumping measures and their relationship with other legislation are analysed conceptually. Different definitions of damping are presented in the fourth chapter. In this chapter, common concepts used in different definitions such as normal value, export price, comparison, dumping margin, injury, causality link, are explained by taking into consideration the existing anti-dumping practices. In the final chapter, WTO, EC and Turkish procedures are elaborated.
