Özet
Tıp biliminin sürekli gelişimi ve insan nüfusunun sürekli artışı sonucunda, günümüzde sağlık hizmetlerinin verilmesinde kamu kurumlarının yanında özel sağlık kurum ve kuruluşlarına da ihtiyaç duyulmaktadır. Devletten aldıkları imtiyazla ve devletin denetimi altında sağlık hizmeti sunan özel hastanelerin sayıları, halkın ihtiyaçları doğrultusunda her geçen gün artmaktadır. Özel hastaneler kamusal sağlık hizmeti vermelerine karşı diğer yandan da ticaret şirketi şeklinde kurulmaları nedeniyle yükümlülükleri hizmet sektöründeki diğer işletmelere göre bazı farklılıklar göstermektedir. Devlet, tüm insanların yaşamını, vücut ve akıl sağlığı içinde devam ettirmesini sağlamaktadır. Anayasa, ülke genelinde sağlık hizmetlerini etkin bir şekilde sürdürme görevini Devlete vermiştir. Bu görev kapsamlı bir şekilde belirtilmiştir. Ülkedeki sağlık kuruluşlarını tek elden planlayıp, bu sağlık kuruluşlarının kaliteli hizmet vermesini mevzuatlar ışığında düzenlemeli ve denetlemelidir.“Anayasa'ya göre; sağlık hizmetleri kamu ve özel sağlık kurumları tarafından sunulacak, buna ilişkin planlama, düzenleme ve denetim devlet tarafından yerine getirilecektir.”Devlet, kamu ve özel kesimlerdeki sağlık ve sosyal kurumlarından doğru şekilde yararlanarak bu görevini yerine getirmektedir. Sağlık hizmetinin asil sahibi olan idarenin, ruhsat yöntemi ile bu hizmeti özel kişiye gördürmesi sırasında denetim sorumluluğu devam etmektedir. Bu çalışmada da ilk olarak özel hastaneler tarafından verilen sağlık hizmetleri üzerinde durulacaktır. Sonrasında il sağlık müdürlüklerinin özel hastaneler üzerindeki denetim yetkisinden söz edilecektir. Mevzuatta özel hastanelerin uyması gereken yükümlülükler ile bu yükümlülüklerin ihlali halinde uygulanacak yaptırımlara yer verilecektir. İl sağlık müdürlüklerinin özel hastaneleri denetleme yöntemleri üzerinde durulacaktır. Denetimler sonucunda özel hastanelere uygulanan yaptırımlar ve bu yaptırımların hukuki niteliği incelenecektir. İdare denetim sorumluluğunu mevzuatlara uygun bir şekilde yapmaması sonucunda, özel hastanede meydana gelen zarar denetim yetkisi ile ilişkileniyor ise bu durumda idarenin sorumluluğundan söz edilecektir.

As a result of the continuous development of medical science and the continuous increase in the human population, there is a need for private health institutions and organizations in addition to public institutions in the supply of health care services today. The number and types of private health care institutions and organizations that provide health services with the privilege they receive from the government and under the control of the government are increasing day by day in line with the needs of the society. When compared with other institutions in the service industry, private health institutions are different in the sense that while they provide health services, which is a public service often provided by the government, they are still businesses. To ensure that the state maintains everyone's life in physical and mental health, the government has the duty and the authority to plan and organize health institutions from a single source in order to realize cooperation by increasing savings and efficiency in human and material power. The government fulfills this duty by utilizing and supervising health and social institutions in the public and private sectors. Accordingly, the legislator assigned the duty of executing health services to the State as a constitutional duty, and also determined the general lines of this duty. In this context, health services will be provided by public and private health institutions, and the relevant planning, regulation and supervision will be done by the government. Public administration is including some responsibility for determining the policies and programs of governments. Accurately, it is the planning, , directing, organizing coordinating, and controlling of government performance. State which is the principal owner of the health service, makes this service available to a private person with the license method, the responsibility of supervision and surveillance continues. In this study, the control and surveillance authority of the provincial health directorates over the health care services carried out by private hospitals will be point up. In these circumstances, the duty to which private hospitals are subject and punishment to be applied in case of breaking of these obligations will be included. The method of inspection of private hospitals by the Provincial Health Directorates will be emphasized. In addition, the sanctions applied as a result of these inspections, and the administrative penalties that take place in the doctrine and judicial jurisprudence will be examined. If the failure of the administration to fulfill its inspection responsibility can be associated with the damage occurred in the private hospital, in this case, the liability of compensation for the loss of the administration will be mentioned.
