Özet
Bu çalışmada, 5237 sayılı Türk Ceza Kanunu'nun 158/1-f maddesinde düzenlenen“Bilişim Sistemlerinin Araç Olarak Kullanılması Suretiyle Dolandırıcılık”suçu incelenmiştir. Söz konusu suçun, dolandırıcılık suçunun nitelikli hallerinden biri olması gözetilerek, suçun temel şeklinin suç genel teorisi kapsamında incelenmesi ve her bir başlıkta suçun bilişim sistemlerinin araç olarak kullanılması suretiyle işlenmesi durumunun arz ettiği özelliklere yer verilmesi yöntemi tercih edilmiştir. Dolandırıcılık suçunun öne çıkan unsuru olan“hile”ve çalışmanın konusunu oluşturan nitelikli halin unsuru olan“bilişim sistemi”kavramları detaylıca analiz edilerek öğretideki görüşlere ve uygulamayı izlemeye yardımcı olacağı düşünülen yargı kararlarına yer verilmeye çalışılmıştır.

In this study, the crime of“Aggravated Fraud Through The Use Of Information Systems”, regulated in Article 158/1-f of the Turkish Penal Code No. 5237, is examined. Considering that the crime aforementioned is one of the qualified forms of the crime of fraud, the method of examining the basic form of the crime within the scope of the general theory of crime and including the characteristics of the crime committed by using information systems as a tool in each heading has been preferred. The concepts of“cheating”, which is the prominent element of the crime of fraud, and“information system”, which is the element of the qualified form that constitutes the subject of the study, have been analyzed in detail and the opinions in the doctrine and the judicial decisions that are thought to help observe the practice have been tried to be included.
