Özet
Bir kavramın hukuki niteliğinin belirlenmesi kritik bir öneme sahiptir. Bu belirleme, uyuşmazlıklara hangi hükümlerin uygulanacağı, sorumluluk rejimleri ve tarafların hak ve yükümlülüklerini saptamak açısından önem taşır ancak öncelik her zaman niteliğinin belirlenmesidir. Özellikle modern çalışma düzenlerinde yer alan“esnaf kuryelik”kavramı, gig ekonomi bağlamında dikkat çekmektedir. Esnaf kuryeliğin hukuki niteliğinin tespiti, sadece teorik değil, pratik sonuçlar açısından da önemlidir. Esnaf kuryelik, adlandırıldığı gibi bir esnaflık faaliyeti mi yoksa bağlı çalışan niteliğine mi dahil olup olmadığı gibi sorular, bu konu özelinde yapılacak hukuki düzenlemelerin ve uyuşmazlık çözüm yöntemlerinin temelini oluşturmaktadır. Bu tez, esnaf kuryelik kavramını Türk Ticaret Kanunu ve Esnaf ve Sanatkârlar Meslek Kuruluşları Kanunu çerçevesinde belirlenmiş unsurlar çerçevesinde ele alacaktır. Ardından esnaf kuryelik, çeşitli sözleşme tipleriyle karşılaştırılacaktır. Bunlar arasında simsarlık, acentelik, komisyonculuk, vekalet ve iş sözleşmesi yer alır. Özellikle bağımlılık unsuru, nitelik tartışmasında ön plana çıkmaktadır. Esnaf kuryelerin taşıma faaliyeti dolayısıyla Posta Hizmetleri Kanunu ve Karayolu Taşıma Kanunu gibi sektörel düzenlemelerle ilişkisi incelenecektir. Tez, esnaf kuryelik faaliyetinin hukuki niteliğini doğru bir zemine oturtarak, bu alandaki belirsizlikleri gidermeyi hedeflemektedir.

Determining the legal status of a concept is of critical importance. This determination is important in terms of determining which provisions will be applied to disputes, liability regimes and the rights and obligations of the parties, but the priority is always to determine its status. Especially the concept of“ tradesman courier”, which takes place in modern working orders, draws attention in the context of gig economy. Determining the legal status of tradesman couriering is important not only theoretically but also in terms of practical consequences. Tradesman couriering, whether it is a tradesman activity as it is called or whether it is included in the qualification of dependent employee, forms the basis of legal regulations and dispute resolution methods to be made on this subject. This thesis will examine the concept of artisan couriering within the framework of the Turkish Trade Law and the Law on Tradesmen and Artisans Professional Organizations. It will then compare tradesman courier services with various types of contracts. These include brokerage, agency, commission, representation and labor contract. Especially the element of dependency comes to the forefront in the qualification discussion. Due to the transportation activity of tradesman couriers, their relationship with sectoral regulations such as the Postal Services Law and the Highway Transportation Law will be examined. The thesis aims to eliminate the uncertainties in this field by placing the legal status of the tradesman courier activity on the right ground.
