Özet

Bu araştırma, 1./7. asrın son çeyreği ile 2./8. asrın ilk yarısında yaşamış, tedvin ve tasnif dönemlerini tecrübe etmiş, pek çok âlim/münekkit tarafından güvenilir addedilmiş, Abdullah b. Ömer'in (ö. 73/693) rivayetlerine en yakın hocası ve ilminin asıl kaynağı olarak tespit edilen Nâfi' Mevlâ İbn Ömer (ö. 117/735) ile ulaşmış ve onun rivayetlerini kendinden sonraki nesle aktarmada âdeta bir köprü vazifesi görmüş, Medine fakihlerinin ilmini yüklenen pek çok isimden istifade etmiş olan Ubeydullah b. Ömer b. Hafs (ö. 147/764) ve Cüz'ünü konu etmektedir. Çalışmada Ubeydullah b. Ömer b. Hafs'ın entelektüel biyografisi isnâd, ricâl ve tematik verilerle ortaya konulmuş, yakın hoca ve öğrencileri tespit edilmiş, hadis tarihindeki konumu/rolüne dikkat çekilmiştir. Ubeydullah b. Ömer bir nüshaya sahiptir ancak çalışmanın konusu olan eserin müellif nüshası değil, mürettibinin Şuayb b. İshâk olduğu ortaya konulmuştur. Eserin diğer rivayetlerinin de tespit edilmesiyle birlikte Şuayb b. İshâk nüshasının bu nüshalar arasındaki konumu, farklılıkları ve benzerlikleri, yayılım yönü konu edilmiştir. Tespit edilen tüm rivayetleri ile Ubeydullah b. Ömer b. Hafs'ın nüshasının ise inşa edilebileceğine dikkat çekilmiştir. Ubeydullah b. Ömer b. Hafs'ın rivayetlerinin Şuayb b. İshâk yoluyla değil de diğer râvileri vasıtasıyla 3./9. asır koleksiyonlarına intikal ettiği tespit edilmiştir. Tüm bu zikredilenlerle beraber Cüz'ün tanıtımı yapılmış, muhtevası usûl açısından analiz edilmiş ve üçte ikisini namaz, talâk ve hac konularını muhtevi rivayetlerin oluşturduğu hadislerle fıkhı yansıtan bir fetva kitabı olduğu sonucuna ulaşılmıştır.

This research is about 'Ubaid Allāh Ibn 'Umar Ibn Hafs (d. 147/764) and his juz, who lived in the last quarter of the 1st/7th century and the first half of the 2nd/8th century, experienced the periods tadwin and classification, was considered reliable by many scholars/critics, reached the narrations of Abd Allāh Ibn 'Umar (d. 73/693) throgh Nāfi' the mawlā of Ibn 'Umar (d. 117/735), who is considered his closest teacher and the main source of his knowledge and who served as a bridge in transferring his narrations to the next generetion and who benefited from many names who undertook the knowledge of the Medina jurists. In this study, the intellectual biography of 'Ubaid Allāh Ibn 'Umar Ibn Hafs is presented with isnād, and rijāl and thematic data, his close teachers and students are identified, and his position/role in the history of hadith is emphasised. It was revealed that it was not the author's copy of the work, but its compiler Shu'aib Ibn İsḥāq. With the identification of other narrations, the position of the copy of Shu'aib Ibn Isḥāq among these copies, their differences and similarities, and the direction of dissemination were discussed. It is pointed out that the copy of 'Ubaid Allāh Ibn 'Umar Ibn Hafs with all the narrations detected can be constructed. It was determined that the narrations of 'Ubaid Allāh Ibn 'Umar Ibn Hafs were transmitted to the 3rd/9th century collections through other narrators, not through Shu'aib Ibn Isḥāq. With all these mentioned, the volume has been introduced, its content has been analysed in terms of methodology, and it has been concluded that it is a fatwa book reflecting fiqh with hadiths, two-thirds of which are narrations on prayer, talaq and hajj.
