Özet
Çalışmanın konusu, profesyonel futbolcu sözleşmesinde ücrettir. Çalışmanın amacı, öğreti ve yargı kararları çerçevesinde, profesyonel futbolcu sözleşmesinde yer alan ücret unsuruna ilişkin uygulanacak yasal düzenlemeler ile ücretin belirlenmesine dair sınırlayıcı hükümlerin tespit edilmesi, ücretin türlerinin incelenmesi, ücretin korunması için getirilen düzenlemelerin ve ücret borcuna aykırılık halinde profesyonel futbolcunun haklarının değerlendirilmesidir. Profesyonel futbolcu sözleşmesine ilişkin temel düzenlemeler, 6098 sayılı Türk Borçlar Kanunu, TFF tarafından yürürlüğe konulan Profesyonel Futbolcuların Statüsü ve Transferleri Talimatı ile FIFA tarafından yürürlüğe konulan RSTP olarak karşımıza çıkmaktadır. Eldeki çalışma, üç bölümden oluşmaktadır. Birinci bölümde, profesyonel futbolcu sözleşmesinin tanımı yapılmış ve hukuki niteliği tespit edilmiştir. Bununla birlikte sözleşmenin şekli, süresi ve tarafları ile sözleşmeye uygulanacak düzenlemeler ele alınmıştır. İkinci bölümde, ücret alacağına uygulanan sınırlayıcı düzenlemelerin, ücret türleri ile ücrette yapılacak kesintilerin ne olduğu, ücretin nasıl ispat edileceği ve ücretin nasıl korunacağı hakkında açıklama yapılmıştır. Üçüncü bölümde ise kulübün ücret borcunu nasıl ifa edeceğine ve ücret borcunun tam ve gereği gibi ifa edilmemesi halinde profesyonel futbolcunun haklarının ne olduğuna ilişkin değerlendirme yapılmıştır.

The subject of the study is remuneration in the professional football player contract. The purpose of the study is, within the framework of doctrine and judicial decisions, to determine the applicable legal regulations concerning the remuneration element in the professional football player contract and the restrictive provisions regarding the determination of remuneration, to examine the types of remuneration, the regulations introduced for the protection of remuneration, and to evaluate the rights of the professional football player in the event of a breach of the wage payment obligation. The main regulations concerning the professional football player contract consist of the Turkish Code of Obligations No. 6098, the Professional Footballers' Status and Transfer Regulation issued by the TFF, and the Regulation issued by FIFA. The present study consists of three chapters. In the first chapter, the professional football player contract is defined and its legal nature is established. Furthermore, the form, duration, and parties of the contract, as well as the regulations applicable to the contract, are addressed. In the second chapter, an explanation is provided regarding the restrictive regulations applied to remuneration claims, the types of remuneration and the deductions to be made from it, how remuneration is to be proven, and how it is to be protected. In the third chapter, an evaluation is made concerning how the club will perform its obligation to pay remuneration and what the rights of the professional football player are in the event that the payment obligation is not performed fully and properly.
