Özet
Uluslararası insancıl hukuk açısından işgal hukuku temel olarak Lahey Hukuku ve Cenevre Hukuku ile oluşmuştur. Lahey Hukuku ve Cenevre Hukuku kapsamında işgal hukukunu oluşturan temel uluslararası hukuk kaynakları 1907 Lahey Savaş Kuralları, IV. Cenevre Sözleşmesi ve I No.lu Ek Protokol'dür. Söz konusu uluslararası antlaşmalara ek olarak UİH'ye ilişkin uluslararası teamül kuralları da işgal hukukunun bir parçasını oluşturur. İşgal hukuku, işgalci devletin, işgal edilen devlet ve işgal bölgesindeki halk ile ilişkisini düzenleyen bir uluslararası hukuk rejimidir. İşgal hukuku, egemen devletin ülkesinde otoritesini tesis eden işgalci devletin, hak ve yükümlülüklerini konu edinir. İşgal hukuku, işgal bölgesindeki kişiler ve eşya üzerinde, işgalci devlete haklar verirken; aynı zamanda işgalci devlete yükümlülükler yükler. Bu kapsamda işgal hukuku; işgalci devlete verilen haklar ve yüklenen yükümlülükler ile işgal bölgesindeki sivilleri himaye eden hükümlerden oluşur. İşgalci devletin; işgal altındaki devlet, işgal bölgesindeki siviller ve işgal bölgesindeki mallar ile ilişkisi, işgal hukuku tarafından düzenlenir. Söz konusu ilişkide; üç farklı menfaat vardır: İşgalci devletin menfaati, işgal altındaki devletin menfaati ve işgal bölgesindeki sivillerin menfaatidir. İşgal hukuku, bu üç farklı menfaatler grubu arasında bir denge kurma çabasının ürünüdür. Çalışmamızın konusunu işgal hukuku oluşturmaktadır. Çalışma konumuz çerçevesinde işgal hukukunun esasları ve işgalcinin işgal bölgesindeki hak ve yükümlülükleri incelenecektir. Çalışmamızda ayrıca işgal hukukunun uygulanmasına yönelik sorunlar ve tartışmalar da ilgili alt başlıklar altında değerlendirilecektir.

In terms of international humanitarian law, the law of occupation is basically formed by the Hague Law and the Geneva Law. The main sources of international law that constitute the law of occupation under the Hague Law and Geneva Law are the 1907 Hague Regulations, the Geneva Convention IV and Additional Protocol I. I In addition to these international treaties, customary international rules on IHL also constitute a part of the law of occupation. The law of occupation is an international legal regime that regulates the relationship of the occupying state with the occupied state and the population in the occupied territory. The law of occupation deals with the rights and obligations of the occupying state that establishes its authority in the territory of the sovereign state. While the law of occupation grants rights to the occupying state over persons and property in the occupied territory, it also imposes obligations on the occupying state. In this context, the law of occupation consists of the rights granted and obligations imposed on the occupying state and the provisions protecting civilians in the occupied territory. The relationship of the occupying state with the occupied state, civilians in the occupied territory and property in the occupied territory is regulated by the law of occupation. In this relationship; there are three different interests: The interest of the occupying state, the interest of the occupied state and the interest of the civilians in the occupied territory. The law of occupation is the product of an effort to establish a balance between these three different groups of interests. The subject of our study is the law of occupation. Within the framework of our study, the principles of the law of occupation and the rights and obligations of the occupier in the occupied territory will be examined. The aim of our study is to examine the sources of international humanitarian law that constitute the law of occupation and to present the concept of occupation in terms of international humanitarian law within the framework of the applicable rules of the law of occupation. In our study, the problems and discussions regarding the implementation of the law of occupation will also be evaluated under the relevant sub-headings.
